1. Acceptance of These Terms

By accessing or using the Services in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Services.

TubeOperator provides:

Free educational blog content about growing YouTube channels with AI.
Gated articles that unlock in exchange for subscribing to our newsletter with your email address.
A weekly newsletter.
Paid online courses and digital products, delivered through our member area and/or third-party platforms.
A community for members.
On-site search, which runs locally in your browser.

We may add, modify, or discontinue any part of the Services at any time.

4. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to purchase a course or digital product from us. By using the Services, you represent that you meet this requirement and, if you are using the Services on behalf of an organization, that you are authorized to bind that organization to these Terms.

5. Accounts and Email Subscriptions

When you subscribe to unlock content or the newsletter, or create an account in our member area or community, you agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. Creating a community account may happen automatically as part of your purchase or signup. You may unsubscribe from marketing emails at any time using the link in each email.

6. Intellectual Property

All content on the Services — including text, graphics, logos, the “TubeOperator” name and marks, video, and course materials — is owned by Ninh Don LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and view our free content for your personal, non-commercial use. You may quote brief excerpts of our free content with proper attribution and a link back to the original source. Any other use requires our prior written permission. Feedback you send us about the Services may be used by us without restriction or compensation to you.

7. Course and Digital Product License

When you purchase a course or digital product, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use it for your own education and for your own YouTube channel or business. You may:

Use templates, prompts, scripts, and workflows included in a course in your own content and business.

You may not, without our prior written permission:

Resell, redistribute, share, or publicly post the course materials or your login credentials.
Re-upload or repost course videos or materials on another platform.
Use the materials to create a competing course or product.

Where we describe a product as offering “lifetime access,” this means access for as long as we continue to offer that product; if we ever discontinue a product, we will give you reasonable advance notice.

8. Payments, Pricing and Taxes

Prices are listed in U.S. dollars unless otherwise stated. Payments are processed by Stripe, PayPal, or Polar; by making a purchase, you authorize the applicable processor to charge your chosen payment method. For purchases made through Polar, Polar is the merchant of record and is responsible for collecting and remitting applicable sales tax, VAT, or GST on that transaction, and its own terms of service also apply to that purchase. Other applicable taxes may be added at checkout. We may cancel or refuse any order placed due to a pricing or listing error. If we offer promotional pricing, coupons, or discounts, additional terms may apply.

If we offer a subscription or installment payment plan for any product, you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel; you may cancel at the end of the then-current billing period, and we will give you reasonable advance notice of any price increase.

9. 30-Day Money-Back Guarantee

Scope: This guarantee applies to paid courses and digital products purchased directly from TubeOperator, regardless of which payment processor (Stripe, PayPal, or Polar) you used.

Window: You may request a full refund within 30 calendar days of your purchase date, as shown on your receipt.

How to request a refund: Email admin@tubeoperator.com with the subject line “Refund Request” from the email address used for your purchase, including your order or receipt ID (your Stripe receipt number, PayPal transaction ID, or Polar order ID). You do not need to give a reason. If you purchased through Polar, you may also request a refund directly through Polar's customer portal.

Processing: We will acknowledge your request within 2 business days and, once approved, issue your refund within 5 business days to your original payment method through the original payment processor. Your bank or card issuer may take additional time, typically 5-10 business days, to post the refund.

Amount: Approved refunds cover the full amount you paid, including any tax collected.

After a refund: your access to the course or product, and any bonuses included with it, will be removed, your license under “Course and Digital Product License” above ends, and you agree to stop using and to delete any downloaded materials.

Payment plans: if you request a refund within 30 days of your first payment, we will refund all amounts paid to date and cancel any remaining installments. Subscriptions: recurring subscription charges are not covered by this 30-day guarantee once billed, but you may cancel future renewals at any time.

Abuse: we reserve the right to deny a refund, or to restrict future purchases, in cases of repeated buy-and-refund abuse or where the materials have been redistributed. Chargebacks: if you have an issue with a purchase, please contact us first — we're glad to help before you contact your bank.

Statutory rights: if you are located in the EU or UK, you may separately have a 14-day right of withdrawal for digital content under applicable consumer law; nothing in this section limits that right.

After 30 days: except as required by law or as stated above, all sales are final.

10. Acceptable Use and Prohibited Conduct

You agree not to:

Use the Services for any unlawful purpose or in violation of any applicable law.
Scrape, crawl, or harvest content from the Services by automated means, or download content in bulk.
Circumvent, disable, or interfere with any access controls, paywalls, or security features.
Reverse-engineer, decompile, or attempt to extract the source code of the Services.
Upload or transmit viruses, malware, or other harmful code.
Impersonate any person, or harass, spam, or abuse other users, including in our community.
Use any content from the Services to train, fine-tune, or evaluate an artificial intelligence or machine-learning model, without our prior written permission.

11. User Content and Community

If our community or Services allow you to post comments, messages, or other content (“User Content”), you retain ownership of your User Content, but you grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display it in connection with operating the Services. You are solely responsible for your User Content and represent that you have the right to post it. We may remove any User Content or restrict your access to the community at our discretion, including for violating these Terms or our community guidelines.

12. Earnings and Results Disclaimer

TubeOperator provides educational content about growing YouTube channels. We make no guarantee, promise, or warranty of any specific level of income, views, subscribers, monetization eligibility, or acceptance into the YouTube Partner Program or any similar program. Any income figures, view counts, growth statistics, or testimonials referenced on our site or in our emails — such as examples of channels or students who have seen significant results — reflect specific, often exceptional, experiences and are not typical; your results will depend on your own effort, niche, content quality, and factors outside our control, including third-party platform algorithms. Nothing on the Services constitutes financial, legal, tax, or professional advice, and you should consult a qualified professional before making business decisions. You are solely responsible for complying with YouTube's Terms of Service and the terms of any AI tool or platform you use.

Affiliate Links

Some links on our Services or in our emails are affiliate links, meaning we may earn a commission if you make a purchase through them, at no additional cost to you. We only recommend products and tools we believe may be useful to creators.

13. Disclaimer of Warranties

THE SERVICES, INCLUDING ALL CONTENT AND COURSE MATERIALS, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF INACCURATE OR OUTDATED INFORMATION.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NINH DON LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless Ninh Don LLC and its officers, members, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of the Services.

16. Third-Party Services, Ads and Links

The Services display advertisements, including through Google AdSense, and embed or link to third-party services such as survey and contact forms and outside websites. We do not endorse and are not responsible for the content, products, or practices of any third party. Any purchase or interaction with a third-party service is governed by that party's own terms.

17. Copyright Complaints (DMCA)

If you believe content on the Services infringes your copyright, send a notice to admin@tubeoperator.com with the subject line “DMCA Notice” that includes:

A physical or electronic signature of the copyright owner or their authorized agent.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material claimed to be infringing and its location on the Services.
Your contact information (address, telephone number, and email address).
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

If you believe your content was removed in error, you may submit a counter-notice with similar information under 17 U.S.C. § 512(g). We may terminate the access of users who are repeat infringers. Submitting a knowingly false infringement notice may result in liability under 17 U.S.C. § 512(f).

18. Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to us or other users. You may stop using the Services, or request deletion of your account, at any time. Sections that by their nature should survive termination — including Intellectual Property, Course and Digital Product License, Earnings and Results Disclaimer, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law and Dispute Resolution — will survive.

19. Governing Law and Dispute Resolution

Before filing a claim, you agree to first contact us at admin@tubeoperator.com and attempt to resolve the dispute informally for at least 30 days.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles.

Except for claims that qualify for small-claims court, any dispute arising from these Terms or the Services will be brought exclusively in the state courts located in Sheridan County, Wyoming, or the U.S. District Court for the District of Wyoming, and you consent to the personal jurisdiction of those courts.

To the extent permitted by law, you and TubeOperator each waive the right to a jury trial and the right to participate in a class action, collective action, or representative proceeding against the other.

Any claim must be brought within one (1) year after it arises, unless applicable law requires a longer period.

If you are a consumer located in the EU or UK, this section does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you reside, and you may bring proceedings in the courts of that country.

20. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms here with an updated “Last updated” date and, for material changes, provide additional notice such as by email. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Changes will not apply retroactively to disputes that arose before the change.

21. General Terms

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented to you at checkout for a specific product, constitute the entire agreement between you and us regarding the Services.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Assignment

You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.

Force Majeure

We are not liable for any failure to perform due to causes beyond our reasonable control.

No Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.

Language

These Terms are drafted in English; any translation is for convenience only, and the English version controls in case of conflict.
